shall not have been redeemed within two years after said sale,
and not set aside by the Court, the said Treasurer shall pro-
ceed with a sale of such property as provided in Chapter 450
of the Acts of the General Assembly of Maryland of 1937.
SEC. 34. The Mayor, Treasurer and Councilmen shall not,
during their term of office, be appointed to any office or posi-
tion in the service of the town. No person seeking appoint-
ment to or promotion in the service of the town shall either
directly or indirectly give, render or pay any money, service
or other valuable thing, to any person for or on account of or
in connection with his appointment, promotion or proposed
promotion.
SEC. 35. No Mayor, Treasurer or Councilman, or any official
or employee of the town shall have a financial interest in any
contract with the town, or be financially interested, directly
or indirectly, in the sale to the town of any land, materials,
supplies or services. Any wilfull violation of this section shall
constitute malfeasance in office, and any officer or employee of
the town found guilty thereof shall thereby forfeit his office or
position. Any violation of this section, with the knowledge,
express or implied, of the person or corporation contracting
with the town, shall render the contract voidable by the Mayor
and Town Council.
SEC. 36. That for the purpose of determining whether the
citizens of said proposed Town of Berwyn desire to incorpo-
rate, there shall be held a referendum election on the first
Monday in May, 1941, under the supervision of the committee
hereinafter named, the manner and procedure of which shall
be as follows:
The Committee to conduct such referendum election shall
consist of Daniel W. Willingmyer, William A. Duvall, Jr.
and Andrew Mothershead, as Judges of Election, and Chester
B. Farnham and Dave Hazard as Clerks of Election, and if
any of said Committee are unable or decline to serve, the
remaining members of said Committee are empowered to select
some resident of said proposed town to fill his place.
The qualification of voters in the referendum election shall
be the same as those hereinbefore set forth for general town
elections.
The said Committee shall provide and furnish a registration
book as hereinbefore provided for each ward, booths, ballot
boxes, tally sheets, printed ballots and the places of regis-
tration and election, and shall not later than April 29, 1941,
post in five conspicuous places in each ward in the said pro-
posed town a typewritten or printed notice notifying all resi-
dents of the proposed town that a referendum election will be
