1138 LAWS OF MARYLAND. [CH. 659

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That seven new sections be and they are hereby added
to Article 1 of the Public Local Laws of Allegany County,
Maryland, title "Allegany County", sub-title "Frostburg", sub-
heading "Parks and Playgrounds", said new sections to be
known as Sections 251A to 251G, both inclusive, and to follow
immediately after Section 250 of said Article, and to read
as follows:

251A. That the Mayor and Councilmen of Frostburg be,
and it is hereby authorized and empowered to acquire from
The Allegany Cemetery Company, a corporation, all the right,
title and interest in and to all the lands commonly known as
Allegany Cemetery, located at or near Frostburg, Maryland;
subject, however, to the following conditions and limitations:
That the purchase price therefor shall not exceed the sum of
$10, 000. 00, which shall not be payable out of any general
funds of the Municipal Corporation, but shall be paid solely
out of 60% of the proceeds of sale derived from future sales
of unsold lots in said original cemetery or the present ad-
dition thereto; and that deferred payments due said Cemetery
Company shall bear interest at the rate of 3% per annum;
and that said interest payments shall likewise be payable
solely from the same source.

251C. That the Mayor and Councilmen of Frostburg are
likewise authorized and empowered to appoint a commission
to be known as "Allegany Cemetery Commissioners", consist-
ing of not less than three (3) nor more than five (5) members,
all of whom shall be citizens of Frostburg, to serve without
pay for a period of two (2) years from the date of appoint-
ment. The Commissioner of Streets and Public Property and
the City Clerk shall be ex officio members of said commission,
and the City Clerk shall act as Secretary of the commission,
and shall keep a full and accurate report of the minutes of
its meetings. The said commission, when appointed, shall
select one of its members as chairman and another one of its.
members as treasurer. The said commissioners are hereby
authorized and directed to assume full power and control over
said Allegany Cemetery and to maintain and regulate the
same and do all things necessary to effectuate the purposes
of this Act. All agreements pertaining to said cemetery shall
be executed in the name of said commissioners, who shall
render a written monthly report to the Mayor and Council-
men of Frostburg of their activities.

251D. That neither the Mayor and Councilmen of Frost-
burg or said commissioners, individually or collectively, shall
