stating that he does not believe such defendant can have a fair
and impartial trial by the trial magistrate before whom the
case is pending.
(b) Upon the filing of any such affidavit, and in a civil case
upon the payment of all costs accrued to the date of removal,
the trial magistrate before whom the case is pending shall
designate some other trial magistrate in the same county to
try the case, and shall forthwith transfer to him all the papers
and a record of the proceedings in the case.
(c) The trial magistrate to whom such case is removed—
(1) in a civil case, shall forthwith set the case for trial
at a time not less than six nor more than fourteen days
from the date the papers are received; shall at once notify
the plaintiff and defendant or their respective attorneys of
the time fixed for trial; and shall take such further action
in the case as if it had originally been instituted before him;
(2) in a criminal case, shall fix such reasonable time for
trial of the defendant as the nature of his offense requires
and law and justice demands,
(d) If any county having only one regular trial magistrate,
removal may be had under this section to the substitute trial
magistrate in that county.
SEC. 2. And be it further enacted, That Section 347 of Arti-
cle 10 of the Code of Public Local Laws of Maryland (1939
Edition), title "Dorchester County", sub-title "Justices of the
Peace and Constables"; Section 245 of Article 12 of said Code,
title "Garrett County", sub-title "Justices of the Peace and
Constables", Section 576 of Article 17 of said Code, title
"Prince George's County", sub-title "Justices of the Peace"
and all other Public General and Public Local Laws or parts
of laws inconsistent with the provisions of this Act be and they
are hereby repealed to the extent of such inconsistency.
SEC. 3. And be it further enacted, That this Act shall take
effect June 1, 1941.
