WHEREAS by Chapter 515 of the Acts of 1937 there were
appropriated for the fiscal year 1938, for purposes therein
set forth, the anticipated proceeds, less certain deductions
of the "One and one-half cent Lateral, County and Munic-
ipal Road Gasoline Tax", and
WHEREAS the receipts from the said "One and one-half
cent Lateral Road Gasoline Tax" have exceeded the antic-
pated net returns and the appropriations for the fiscal
years 1937 and 1938, and there now remains in the
Treasury of the State of Maryland the sum of Three Hun-
dred Fifty Seven Thousand Two Hundred Fifty Four
Dollars and Twenty Cents ($357, 254. 20), representing
Seventy Per Cent. (70%) of the Counties' distributive
share, and
WHEREAS Chapter 92 of the Acts of 1935 and Chapter
515 of the Acts of 1937, containing the budget provisions
and appropriations of the "One and one-half cent Lateral
Road Gasoline Tax" for the years 1937 and 1938, respec-
tively, both contain the following provision:
"The amounts named herein are computed as estimates
only, it being the intention that these appropriations shall
be 100% of the revenue aforesaid, and it being further
the intention that should the proceeds of this tax exceed
the respective amounts herein set forth, then such excess
shall not revert to the General Fund of the State, but shall
be set over to the use of the State Roads Commission to
be allotted by subsequent Legislative action. "
SECTION 1. Be it enacted by the General Assembly of
Maryland, That the Comptroller of the Treasury and the
Treasurer of Maryland, be and they are hereby authorized
and directed to release the aforesaid sum of Three Hundred
Fifty Seven Thousand Two Hundred Fifty Four Dollars
and Twenty Cents ($357, 254. 20) upon proper voucher
approved by the State Roads Commission of Maryland, to
be expended for the purposes and in the amounts herein-
after set forth.
SEC. 2. And be it further enacted, That the State Roads
Commission of Maryland be and it is hereby directed and
empowered to allocate among the Counties of the State
in the proportion to which the public road mileage of the
several Counties bears to the entire road mileage in the
Counties of the State, the said sum for the uses and pur-
poses set forth in Sections 7A, 7B, 7C, 7D, 7E and 7F of
