CHAPTER 408.
(Senate Bill 360)

AN ACT to add a new Section to Article 89B of the Anno-
tated Code of Maryland, 1935 Supplement, title "State
Roads", said new Section to follow immediately after
Section 9 of said Article, and to be known as Section 9A,
to prohibit the removal of dirt, sand, gravel, stone, rock
or any other material from land adjoining any highway
of the State, and providing penalties for violating the
provisions of this Act.

SECTION 1. Be it enacted by the General Assembly of
Maryland,
That one new Section be and the same is hereby
added to Article 89B of the Annotated Code of Maryland,
1935 Supplement, title "State Roads", to follow immedi-
ately after Section 9 of said Article, and said new Section
to be known as Section 9A of said Article, and to read as
follows:

9A. It shall be unlawful for any person to remove such
quantities of dirt, sand, gravel, stone, rock or any other
material from the land adjoining any highway of the State,
so as to affect the surface or construction of said highway,
either by changing the supporting slopes in a fill or the
slopes supporting the adjoining land in a cut, and in cases
where the State Roads Commission has built up protecting
barriers to protect or support any road, such as sand fences,
retaining walls or any other structure, it shall be unlawful
for any person to remove any material hereinbefore men-
tioned which shall be harmful to the construction or
protection of the highway. Any person violating the
provisions of this Section shall be guilty of a mis-
demeanor and shall be fined not less than Ten Dollars
($10. 00) nor more than One Hundred Dollars ($100. 00),
and upon conviction of a second offense in violation of this
statute, shall be fined not less than One Hundred Dollars
($100. 00) nor more than One Thousand Dollars ($1, 000. 00),
and be imprisoned for not more than six months, or in the
discretion of the Court, may be both fined and imprisoned,
as aforesaid.

SEC. 2. And be it further enacted, That this Act shall
take effect June 1st, 1939.
