SEC. 9. And be it further enacted, That if any provision
of this Act shall be declared unconstitutional or invalid by
any Court, such judgment shall not affect, impair or invalidate
the remaining provisions thereof, but shall be confined in its
operations to the specific provision so held unconstitutional
or invalid and the inapplicability or invalidity of any section,
clause or provision of this Act in any one or more instances
shall not be taken to affect or prejudice in any way its ap-
plicability or validity in any other instance.

SEC. 10. And be it further enacted, That this Act shall take
effect on June 1, 1939.

CHAPTER 354.
(House Bill 481)

AN ACT to repeal Sections 3, 4, 5, 13 and 17 of Article 99
of the Annotated Code of Maryland (1935 Supplement),
title "Water Fowl, Birds and Game", and to enact in lieu
thereof seven new sections known as Sections 3, 3A, 4, 5, 13,
17 and 81 of said Article; providing for the appointment of
a State Game Warden, setting forth his duties and powers,
and providing for the disposition of the receipts from hunt-
ing licenses; to repeal and re-enact with amendments Sec-
tions 77 and 82, of Article 39 of said Code; title "Fish and
Fisheries", sub-title "Non-Tidal Waters"; to add a new sec-
tion to Article 39 of said Code; title "Fish and Fisheries",
sub-title "Non-Tidal Waters", said new section to be known
as Section 92A and to follow immediately after Section 92
of said Article, providing that the Maryland State Game
and Inland Fish Commission be substituted for the Con-
servation Commission or Conservation Commissioner wher-
ever used in Sections 71 to 92, inclusive, of said Article 39;
creating and establishing the Maryland State Game and
Inland Fish Commission and placing under its control cer-
tain natural resources of the State, including wild fowl,
birds, game, inland fish and fur-bearing animals; providing
that all revenue from hunting licenses and anglers' licenses
shall be credited to the State Game Protection Fund and
shall not be used for any other purpose than for the salaries
and expenses of the State Game and Inland Fish Commis-
sion, the State Game Warden and his subordinates, and
for the propagation, protection and distribution of wild
