invested capital to the general funds of the Mayor and
Council of Easton hereinbefore provided, and at the end
of each year beginning with the year ending December 31,
1939, all remaining accrued operating profits of the elec-
trical department for the year then ending shall be paid
over into the general funds of the Mayor and Council of
Easton, unless the total cash funds and investments of the
electric department as approved by Chapter 103 of the
Acts of the General Assembly of 1935 be less than the sum
of $50, 000. 00, in which case all or such part of said remain-
ing accrued operating profits as may be necessary to bring
said cash funds and investments to a sum of $50, 000. 00
shall be retained by said electrical department and the
balance of said operating profits if any shall be paid to the
said general funds of the Mayor and Council of Easton.

AN ACT to repeal Sections 23 to 28 inclusive, of Article
11 of the Code of Public Local Laws of Maryland (1930
Edition), title "Frederick County", sub-title "Auditor",
as enacted by Chapter 37 of the Acts of 1939 and to enact
in lieu thereof, six new sections to be under sub-title
"Auditor" to be known as Sections 23 to 28, inclusive
and to follow immediately after Section 22 of said
Article, relating to the appointment, duties and compen-
sation of an Auditor for Frederick County and providing
for a system of accounts for certain offices in said
County.
SECTION 1. Be it enacted by the General Assembly of
Maryland, That Sections 23 to 28, inclusive, of Article 11
of the Code of Public Local Laws of Maryland (1930
Edition), title "Frederick County", sub-title "Auditor", as
enacted by Chapter 37 of the Acts of 1939, be and they are
hereby repealed, and that six new sections be and they are
hereby enacted in lieu thereof, said new sections to be
known as Sections 23 to 28, inclusive, to be under sub-title
"Auditor", to follow immediately after Section 22 of said
Article, and to read as follows:
23. The County Commissioners of Frederick County
shall on or before the first day of June, 1939 and annually
