College, in the event of a transfer, such monies as may
have been appropriated by the General Assembly of
Maryland for the current expenses of Morgan College
and for scholarships for Negroes for each of the fiscal
years 1939, 1940 and 1941; and not paid out by the
Comptroller prior to the transfer; and to authorize said
Commission to determine to what extent the proceeds of
any State loan, that may be authorized by the General
Assembly of Maryland of 1939 for the benefit of Mor-
gan State College, shall be expended by the Board of
Public Works in order to comply with the terms of the
said agreement of transfer, or to purchase additional
land or equipment, or to erect additional buildings, or to
improve the buildings and grounds at the site of the col-
lege, either with or without the aid of such additional
funds as may be received from the United States, such
agreement of transfer and such determination with
regard to the expenditure of the proceeds of the State
Loan to be subject to the final approval of the Board of
Public Works.

SECTION 1. Be it enacted by the General Assembly of
Maryland,
That a new Article be and it is hereby added to
the Annotated Code of Maryland (1935 Supplement), said
new Article to be known as Article 65A, to be under title
"Morgan State College", to follow immediately after
Article 65 of said Code, and to read as follows:

MORGAN STATE COLLEGE.

1. A Commission of five persons, to be known as the
Commision on a State College for Negroes, is hereby estab-
lished, to consider the advisability of the acquisition by the
State of all or part of the property of Morgan College
located on the Hillen Road, in Baltimore City, in order that
the State may establish on that site an educational insti-
tution for Negroes of collegiate or more advanced grade.
The Commission shall consist of John R. Semmes, Chair-
man, H. C. Byrd, B. Howell Griswold, Thomas W. Pang-
born and A. W. W. Woodcock.

The Governor shall have power to fill vacancies occur-
ring in the personnel of the Commission. The members
of the Commission shall serve without pay, but they shall
be entitled to be paid for their necessary expenses out of
any appropriation that may be made for the purpose.

2. Said Commission shall have power to enter into an
agreement on behalf of the State with the Board of Trus-
