508 LAWS OF MARYLAND. [CH. 280

"Special Fund", said new sections to be known as Sections
943A and 943B, and to follow immediately after Section
943 of said Article, authorizing the Police Commissioner
of Baltimore City to establish a Special Fund for the
payment of pensions to widows or minor children of cer-
tain deceased members of the Police Department, pre-
scribing the methods of establishing the Fund, the con-
ditions for the payment of pensions or benefits there-
from and relating to membership and participation in
the said Fund.

SECTION 1. Be it enacted by the General Assembly of
Maryland,
That two new sections be and they are hereby
added to Article 4 of the Code of Public Local Laws of
Maryland and Baltimore City Charter (1938 Edition), title
"Baltimore City", sub-title "Special Fund", said new sec-
tions to be known as Sections 943A and 943B, to follow
immediately after Section 943 of said Article, and to read
as follows:

943A. On and after June 1st, 1939, every active mem-
ber of the Police Department of Baltimore City who has
established eligibility to participate in the benefits of the
Special Fund as provided by Section 940 of this Article,
and every one thereafter appointed to the said Police
Department who becomes eligible to participate in the said
Special Fund, shall, on his own election and in considera-
tion of the payment of an additional contribution to a
special fund to be known as the Special Fund for Widows,
in an amount to be prescribed by the Police Commissioner
but in no event to exceed two per centum (2%) of the base
salary of the grade or position occupied, provide eligibility
for the payment of a pension to his widow until she
remarries, and if there be no widow, or if the widow should
remarry, the pension shall be paid for the benefit of any
child or children of the deceased while under the age of
eighteen (18) years. Every active member of the Police
Department on June 1st, 1939, shall indicate his election
to establish eligibility to participate in the benefits of the
Special Fund for Widows by filing, on or before June 1st,
1939, with the Police Commissioner on a form to be pre-
scribed by said Police Commissioner, his desire so to par-
ticipate and his consent to the deductions to be made from
his salary as shown on the payrolls. Any member who
fails to file such election form on or before June 1st, 1939,
shall thereafter be ineligible to establish eligibility to par-
ticipate in the Special Fund for Widows. These benefits
shall be due and payable in the event of death of a member
