"Speed, Size, Weight, Construction and Equipment of
Motor Vehicles, " relating to the speed at which motor
vehicles may be driven upon public highways.
SECTION 1. Be it enacted by the General Assembly of
Maryland, That Sub-sections (3), (4) and (5) of Section
194 of Article 56 of the Annotated Code of Maryland (19, 35
Supplement), title "Licenses, " sub-title "Motor Vehicles, "
sub-heading "Speed, Size, Weight, Construction and Equip-
ment of Motor Vehicles, " be and they are hereby repealed
and re-enacted, with amendments, to read as follows:
(3) Speed of Other Vehicles. No motor vehicle shall
be operated upon any public highway of this State at a
rate of speed exceeding twenty-five miles an hour on ordi-
nary highways or thirty miles per hour on dual lane boule-
vard highways in the thickly settled or business parts of
cities, towns and villages, or thirty miles per hour on ordi-
nary highways or thirty-five miles per hour on dual lane
highways in the outlying or not thickly settled parts of
cities, towns or villages. No motor vehicle equipped with
a commercial body, the weight of which including the
body and load, is greater than three (3) tons shall be
operated at a rate of speed greater than forty miles per
hour under any circumstances.
(4) Maximum of Speed. No motor vehicle shall be
operated upon any highway of this State at a rate of speed
greater than fifty miles per hour, or fifty-five miles per hour
on dual lane boulevard highways, under any circumstances
or condition, nor shall any motor vehicle be operated with
a greater load than that for which the registration cer-
tificate therefor has been issued and fee paid.
(5) Penalties. Any person violating any of the pro-
visions of Sub-sections (1) or (3) of this section shall be
deemed guilty of a misdemeanor and subject to a fine of
not less than one dollar ($1. 00) nor more than one hun-
dred dollars for the first offense. Any person violating any
of the provisions of Sub-section (2) of this section shall
be deemed guilty of a misdemeanor and subject to a fine
of not less than five dollars ($5. 00) nor more than one
hundred dollars ($100. 00) for the first offense. Any
person operating a motor vehicle upon any highway of this
State at a rate of speed greater than fifty miles per hour,
or fifty-five miles per hour on dual lane boulevard high-
ways, shall be deemed guilty of a misdemeanor and subject,
upon conviction, to a fine of not less than ten dollars
($10. 00) nor more than one hundred dollars ($100. 00).
