the Code of Public Local Laws of Maryland (1930 Edition),
title "Montgomery County", sub-title "Licenses", said new sec-
tion to be known as Section 368B and to follow immediately
after Section 368A of said Article and to read as follows:

368B. From, on and after April 1, 1939, it shall be unlawful
for any person, association, firm, corporation, incorporated
town or special taxing area, engaged in the business of col-
lecting or disposing of garbage, trash, junk or other refuse,
to collect or dispose of any such garbage, trash, junk or
other refuse by feeding, dumping, incinerating or other final
disposition, within the confines of Montgomery County, Mary-
land, unless said person, association, firm, corporation, incor-
porated town or special taxing area shall have obtained a
permit from the Board of County Commissioners of Mont-
gomery County, and such collection or disposal shall be in
accordance with such rules and regulation, which may include
the imposition of reasonable fees to cover the cost of inspec-
tion and licensing, as the Board of County Commissioners
shall, from time to time, prescribe, provided, however, that
no incorporated town or special taxing area shall be required
to pay any fees for said inspection and licensing. Any viola-
tion of this Act shall constitute a misdemeanor, and any person
convicted thereof before a Justice of the Peace or court of com-
petent jurisdiction shall be punished by a fine of not less than
Five Dollars ($5. 00) nor more than Fifty Dollars ($50. 00),
or by imprisonment for not less than thirty (30) days nor more
than ninety (90) days, or both, in the discretion of the Court.

SEC. 2. And be it further enacted, That this Act is hereby
declared to be an emergency law and necessary for the imme-
diate preservation of the public health and safety, and being
passed by a yea and nay vote, supported by three-fifths of all
the members elected to each of the two Houses of the General
Assembly, the same shall take effect from the date of its
passage.
