716N. Whenever used in Sections 716 to 716N of this
Article:

(a) "People's Court" or "Court" shall mean the Chief
Judge and Associate Judges of the People's Court of Balti-
more City, individually or, in the event of the creation of
a People's Court of Baltimore City by constitutional amend-
ment, shall refer to the Court so created;

(b) "Judge" shall mean one of the Justices of the
Peace appointed pursuant to Section 716 of this Article
or, in the event of the creation of a People's Court of
Baltimore City by constitutional amendment, shall mean
a Judge appointed or elected in accordance with such
amendment;

(c) "Constable" shall mean a constable appointed in
accordance with the Constitution as amended from time
to time;

(d) "Clerk" or "Clerk of the Court" shall mean any
person appointed or designated to do clerical work or to
give clerical assistance.

SEC. 3. And be it further enacted, That Section 748 of
Article 4 of the Code of Public Local Laws of Maryland
(1938 Edition), title "Baltimore City, " subtitle "Landlord
and Tenant, " be and the same is hereby repealed and re-
enacted with amendments to read as follows:

748. If any Justice of the Peace in Baltimore City dies,
resigns or is removed, or upon the expiration of his official
term, his docket and papers shall be delivered to the Clerk
of the City Court within thirty days thereafter; provided,
however, that this section shall not apply to any of the
three Justices of the Peace appointed for the People's
Court, whose dockets and papers shall be retained in the
custody of the Chief Constable.

SEC. 4. And be it further enacted, That all acts or
parts of acts of any public general or public local laws
inconsistent with the provisions of this Act be and the
same are hereby repealed to the extent of such incon-
sistencies.

SEC. 5. And be it further enacted. That, if any func-
tion, power or duty conferred or imposed upon said Judges
by this Act would be invalid if applied to Justices of the
Peace, such function, power or duty shall be construed to
apply only to Judges of a People's Court created by amend-
