have had at least five years experience in the treatment of
the insane; and one at least of said Board shall be a
woman. All of the associate members shall be appointed
by the Governor with the advice and consent of the Senate,
except that the associate members first appointed under
this Act shall be appointed by the Governor alone and their
terms of office shall begin on January 1, 1923. The asso-
ciate members of said Board shall hold office for six
years, provided that those first appointed under this Act
shall be so classed by the Governor that the terms of office
of two shall expire on the first Monday of May, 1924, the
terms of office of two on the first Monday of May, 1926,
and the terms of office of two on the first Monday of May,
1928, and thereafter in each case the Governor, with the
advice and consent of the Senate, shall appoint two mem-
bers in the place of the two whose terms shall so expire.
All vacancies shall be filled by the Governor, with the
advice and consent of the Senate.

The Commissioner of Mental Hygiene shall be a quali-
fied physician who at the time of his appointment has had
at least five years' actual experience in the treatment of
mental diseases. He shall be appointed as follows: On
the taking effect of this Act, the associate members of the
Board, or a majority of them, shall designate and nomi-
nate to the Governor the man in their judgment best fitted
for the position, and the Governor shall thereupon appoint
such nominee Commissioner of Mental Hygiene. The Com-
missioner shall hold such office as long as he shall faith-
fully and efficiently discharge the duties thereof. He may
be removed by the Governor for cause, after an opportu-
nity for a hearing, and any vacancy occurring in the office
shall be filled in the manner heretofore provided.

The Commissioner of Mental Hygiene shall receive such
salary as is fixed by the budget, and associate members
of the Board of Mental Hygiene shall serve without pay.

No member of said Board shall in any way, directly or
indirectly, have any pecuniary interest in any place in
which the insane are confined or in the management or
supplies or treatment of such insane.

SEC. 5. And be it further enacted, That Section 41 of
Article 59 of the Annotated Code of Maryland, title "Luna-
tics and Insane, " sub-title "Board of Mental Hygiene, " be,
and the same is hereby repealed and re-enacted, with
amendments, so as to read as follows:

41. Whenever the Commissioner of Mental Hygiene,
after investigation, determines that any patient in any
State hospital for mental patients can be given better or
