1590 LAWS OF MARYLAND. [CH. 739

SEC. 4. And be it further enacted, That the male and fe-
male citizens of the town of Cresaptown of the age of twenty-
one (21) years and upwards, who are citizens of the United
States, who have resided in said town for and during a period
of six months next preceding the first Tuesday in August in
each two years and at such place or places as may be desig-
nated by the Mayor and Commissioners of Cresaptown for
holding elections in said town, are authorized to elect four
Commissioners for said town, and one person to serve as
Mayor and one to serve as Clerk of said town, each of whom
shall have resided in said town for a period of at least one
(1) year preceding their election, and shall own property of
not less than Five Hundred Dollars ($500) within the town
limits.

The Commissioners elected tinder this Act shall serve for
two and four (2 and 4) years respectively or until their suc-
cessors are elected and qualified, and it is hereby provided
that the two Commissioners receiving the highest number of
votes at the first election to be held under the provisions of
this Act shall be elected for four (4) years and the other two
shall be elected for two (2) years, and at each election there-
after two Commissioners shall be elected for a term of four
(4) years. The Clerk and Mayor to be elected under the pro-
visions of this Act, shall, after they have qualified, hold their
respective offices for a period of two years, or until their suc-
cessors are elected and qualified.

SEC. 5. And be it further enacted, That the Mayor, Clerk
and the Commissioners elected under the provisions of this Act
shall qualify on the 4th Monday in September in each year after
the election by taking the following oath, to be administered
by some Justice of the Peace of Allegany County, Maryland:

I,................................. do swear (or affirm)

that I will execute the office of Mayor (or Clerk or Commis-
sioner as the case may be) to the best of my ability, without
prejudice, fear, favor or partiality.

SEC. 6. And be it further enacted, That the Mayor of said
town shall preside at all meetings of the Mayor and Com-
sioners of Cresaptown and shall be entitled to vote upon any
motion or question before them for decision, and he shall exe-
cute all ordinances passed by them and he shall be ex officio
chairman of all committees appointed by them.

SEC. 7. And be it further enacted, That the Mayor and Com-
missioners shall meet whenever called by the Mayor and as
often as the occasion may require for the welfare and good
government of said town, but not less than once a month.
