CHAPTER 734.
(House Bill 482)

AN ACT to add seven new sections to Article 2B of the Anno-
tated Code of Maryland (1935 Supplement), title "Alcoholic
Beverages", sub-title "County Dispensaries", said new sec-
tions to be known as Sections 48K to 48Q, inclusive, and to
follow Section 48J of said Article, relating to the sale of
alcoholic beverages in Harford County; creating a Liquor
Control Board for said county and prescribing its powers
and duties, including the power to issue licenses for the
sale of the beverages defined in Section 421A of Article 13
of the Code of Public Local Laws; defining where said dis-
pensaries shall be located and the disposition of the net
proceeds therefrom; prescribing the penalties for the vio-
lation of the provisions of this Act, or for anyone holding
a license for the sale of beverages as defined in said Sec-
tion 421A of said Article 13, to have in his possession alco-
holic beverages containing more than 14% of alcohol by
volume; defining the penalties for said violations; and giv-
ing the Sheriff of Harford County, his Deputies or other
Peace Officers the right of search and seizure under certain
conditions; providing that one-half of the net proceeds de-
rived from the Liquor Dispensaries in Harford County shall
be paid to the County and that one-half thereof shall be paid
to the respective Towns in which the dispensaries are lo-
cated, and provided further that the net proceeds derived
from the Liquor Dispensary in Bel Air are first dedicated
to the retirement of the bonds and the debt service thereon
issued under the provisions of Chapter 28 of the Acts of the
General Assembly of Maryland, 1939; providing that on the
day of the General Election, to be held in November, 1940,
the voters of the Towns of Aberdeen and Bel Air and the
City of Havre de Grace, who are qualified to vote in Town or
City Elections, shall by a referendum vote decide whether
the Dispensaries created under the provisions of this Act
shall continue to exist after April 1, 1941; and providing
further that if ten per cent (10%) of the voters of any Elec-
tion District in Harford County, other than those living
within the corporate limits of Bel Air and Havre de Grace,
shall on or before the first day of October, 1940 file a petition
with the Supervisors of Election of Harford County, they
may have the question of whether a Liquor Dispensary shall
be established in such District placed upon the Ballot at
the November Election and decided by the voters of such
District, and if a majority of the voters in any District vote
in favor thereof, this Act shall apply to any such District.
