not exceeding Twenty-five Dollars ($25. 00) and may be prose-
cuted therefor in any court of competent criminal jurisdiction.
If a person in attendance before the Board refuses, without
reasonable cause, to be examined, or to answer a legal and
pertinent question, or to produce a book or paper when ordered
to do so by the Board, the Board may apply to any judge of
the Circuit Court for Montgomery County, upon proof of
affidavit of the fact, for a rule or order returnable in not less
than two nor more than five days, directing such person to
show cause before the judge who made the order, or any other
judge aforesaid, why he should not be committed to jail; upon
the return of such order, the judge before whom the matter
shall come on for a hearing shall examine under oath such per-
son, and such person shall be given an opportunity to be heard;
and if the judge shall determine that such person has refused,
without reasonable cause or legal excuse, to be examined or to
answer a legal and pertinent question, or to produce a book or
paper which he was ordered to bring or produce, he may forth-
with commit the offender to jail, there to remain until he sub-
mits to do the act which he was so required to do, or is dis-
charged according to law.

Sec. 17. There is hereby created a fund designated and
known as the Police Belief and Retirement Fund of Mont-
gomery County. All of the moneys of said fund shall be pay-
able to the Treasurer of Montgomery County, and shall be paid
out by Mm upon certificate of the Police Civil Service Commis-
sioner. The said fund shall consist of all fines imposed by the
Police Trial Board upon members of the Police Department of
said County by way of discipline, all rewards, proceeds of gifts,
and emoluments that may be received by any member of said
Department for extraordinary services, except such part there-
of as the County Commissioners may allow to be retained by
members of said Department; a deduction of five per cen-
tum of the monthly salary of each member of said Police De-
partment; donations, and the net proceeds of sales of un-
claimed property in the custody of the Police Department; all
of which shall be paid to the Treasurer of Montgomery County
to the credit of said fund, and should the said fund at any time
be insufficient to defray the expenditures hereinafter provided
for, the County Commissioners, in that event, are authorized,
and it shall be their duty, to levy upon the taxable property
of Montgomery County a tax sufficient to provide for such
deficits; to pay to the Treasurer of Montgomery County, to the
credit of said "Policemen Belief and Retirement Fund of Mont-
gomery County, " such sums as may be necessary from time to
time to meet deficiencies in said fund. The moneys to the
credit of the said fund shall be available only for expenditures
