otherwise to be improved under the provisions of this Section,
requesting the grading, paving, macadamizing, placing sewers
or otherwise improving any of such streets, roads or lanes, it
shall be the duty of said Citizens' Committee to make the
assessment against the abutting property owners, to provide
the funds for and cause to be performed the necessary work
or construction to be done in accordance with the provisions
herein provided. And provided further, that this Section shall
not apply to repairs to macadamized streets, sidewalks, cross-
ing's and gutters.
SEC. 3. And be it further enacted, That a new section be,
and it hereby is added to Article 16 of the Code of Public
Local Laws of Maryland (1930 Edition), title "Montgomery
County", sub-title "Chevy Chase—Section 2", said new section
to be known as Section 90A, to follow immediately after Sec-
tion 90 of said Article, and to read as follows:
90A. For the purpose of making the improvements pro-
vided for in Section 90 of this sub-title or for making improve-
ments from time to time other than maintenance and repairs,
the said Citizens' Committee is hereby authorized and em-
powered to borrow money and otherwise contract indebtedness
and obligate said Sections of the Village of Chevy Chase, in
amounts not exceeding in total at any time three (3) per cent
of the assessed valuation of the real property within said Sec-
tions and for these purposes said Sections of the Village of
Chevy Chase shall be and hereby are constituted a corporation,
and the said Citizens' Committee is empowered to act for said
corporation.
SEC. 4. And be it further enacted, That Section 94 of Article
16 of the Code of Public Local Laws of Maryland (1930 Edi-
tion), title "Montgomery County", sub-title "Chevy Chase—
Section 2", be and the same hereby is repealed and re-enacted,
with amendments, to read as follows:
94. The Treasurer of said Village of Chevy Chase shall de-
posit all funds coming into his hands as such, in accordance
with the requirements of law, for the deposit of County funds
by the County Treasurer, or in some other bank approved by
the Citizens' Committee; provided, that the Treasurer of said
Village of Chevy Chase shall not dispose of any of the funds
coming into his hands as such Treasurer, except upon check
duly signed by him as such Treasurer and countersigned by the
Chairman or some member of the said Committee acting as
Chairman protem in his absence. Such acting Chairman shall
be duly authorized to act by resolution of said Committee,
which must be first placed upon the minutes of the Committee
to be provided therefor.
