name in the Town Register, or influencing any judge of elec-
tion in the discharge of his duties, shall be deemed to consti-
tute perjury and shall be punishable under the laws of the
State of Maryland relating to such offenses.

(f) In the event of the Commissioners failing to proclaim
an election at the time appointed in sub-section (a) of this sec-
tion or the neglect of the Commissioners to do any needful
thing prescribed therein to ensure the holding of a legal elec-
tion to elect their successors, the Circuit Court of Prince
George's County shall, upon the petition of five residents of
the town of Berwyn Heights eligible to vote in town elections,
appoint five taxpaying voters of the town to conduct an elec-
tion in the manner in this section provided on an early date
to be fixed by the Court.

34. The commissioners may pass such ordinances, not in-
consistent with law, as in their judgment may be for the in-
terest of the town and provide in such ordinances the penal-
ties and punishments for violation thereof; they shall have
supervision over the walks, streets, roads and alleys of said
town; may open and close streets, lanes and alleys, grade and
pave the same; restrain all disorder and disturbances in said
town; abate nuisances therein; provide for removal of obstruc-
tions from streets, lanes and alleys; establish building lines;
prevent animals from running at large; provide for the pro-
tection of the public health, safety and welfare; exercise all
the police power necessary to order the removal of nuisances or
dangerous conditions from any lots or private premises in said
town and provide penalties for the violation thereof; grant
and recall licenses at their discretion for the operating or con-
ducting of any and all places of public amusement and enter-
tainment and business and fix the fees to be paid on the grant-
ing of any such license; and any ordinance passed by said
commissioners may provide for its enforcement by a prosecu-
tion before any Justice of the Peace of Prince George's County.
A majority of said commissioners shall constitute a quorum
and the act of such majority shall be the act of the whole
Board of Commissioners.

37. Upon a petition signed by twenty-five per centum of
the voters of said town requesting the recall of any one of the
said commissioners on failure properly to perform the duties of
his office, said commissioner shall hold a special election at
which the voters of said town shall vote for or against the re-
call of said commissioner, and in the event the majority are in
favor of said recall, the office of said commissioner shall be
declared by the said commissioners vacant, and the vacancy
filled by a special election as provided for in this charter in
the case of general elections.
