part of said Board to make such certificate or to post copies
thereof, or failure to do both of these facts, shall not in-
validate such election. If said Board shall so fail to make
such certificate, and post copies thereof, then it shall be the
duty of the Hillside Commission to make such certificate and
post such copies thereof.
(R) That after said Board shall have counted the ballots
and votes, and ascertained the result of the election, said
Board shall file with the Hillside Commission all records and
books in connection with such election.
(S) That each of the Commissioners so elected shall, on or
before the third Monday in May of the year when he shall have
been elected, qualify as such Commissioner by taking an oath
of office as prescribed by Paragraph J of Section 3 of this
Act.
(T) That in case any person so elected to the office of com-
missioner shall fail so to qualify, or in case of any vacancy in
the office of commissioner by death, resignation or otherwise,
the remaining commissioners shall fill such vacancy by ap-
pointment. Any person so appointed shall possess the qualifi-
cations stated in this Act, shall be a resident of the town of
Hillside, and shall qualify by taking the oath of office within
three (3) days after his said appointment.
(U) That in making appointment to fill any such vacancy
in the office of commissioner the remaining qualified commis-
sioners shall make such appointment by entering in the min-
ute books of said Commission the fact of their making such
appointment, and the same day notifying the person so ap-
pointed of his said appointment. And the remaining qualified
commissioner in making such appointment shall appoint as
commissioner such person who was a candidate at the last
election, and who received the six greatest number of votes.
If the person so appointed fails to qualify, then the remaining
qualified commissioners shall appoint as such commissioner
such person who was a candidate at the last election, and who
received the seventh greatest number of votes. And if there
be no available candidates at the last election, then said re-
maining qualified commissioners may appoint any person,
provided the person so appointed is eligible, to the office of
commissioner under the provisions of this Act.
SEC. 11. And be it further enacted:
(A) That for the purpose of determining1 whether the resi-
dents of the Town of Hillside desire to incorporate, there
shall be held an election in said town, between the hours of
7 A. M. and 7 P. M. on the Twenty-seventh (27th) day of May,
in the year 1939.
