1204 LAWS OF MARYLAND. [CH. 604
CHAPTER 604.
(House Bill 783)

AN ACT to add two new sections to Article 12 of the Code of
Public Local Laws of Maryland, title "Garrett County",
sub-title "Oakland", to be known as Sections 416A and 416B,
providing that the Mayor shall have the right to vote on
all town matters and providing for the appointment of cer-
tain officials of the town of Oakland.

SECTION 1. Be it enacted by the General Assembly of Mary-
land,
That two new sections be and they are hereby added to
Article 12 of the Code of Public Local Laws of Maryland,
title "Garrett County", sub-title "Oakland", said new sections
to be known as Sections 416A and 416B, to follow immediately
after Section 416 of said Article and to read as follows:

416A. The Mayor of the Town of Oakland shall have the
right to vote on all matters brought before the Mayor and
Town Council in the same and like manner as the members
of the Town Council now have.

416B. All candidates for the offices of clerk, police magis-
trate, attorney, weighmaster, street commissioner, water su-
perintendent and policemen shall file a written application
with the Mayor and Town Council before the first Monday
in April in each and every year. From this list of candidates
the Mayor and Town Council shall elect one individual from
each list to fill that particular office. The Mayor is to have
a vote on the election of these candidates along with the
Councilmen, and a majority of the votes cast is necessary for
election.

SEC. 2. And be it further enacted, That all Acts or parts of
Acts inconsistent herewith be and the same are hereby re-
pealed to the extent of such inconsistency.

SEC. 3. And be it further enacted, That this Act is declared
to be an emergency law, necessary for the immediate preserva-
tion of the public health and safety, and being passed upon
by a yea and nay vote, supported by three-fifths of the mem-
bers elected to each of the two Houses of the General Assembly
of Maryland, the same shall take effect from the date off its
passage.
