3. Any unexpended balance of an appropriation for the
acquisition of land, buildings, equipment, new construction,
or other capital expenditure, whether made through a budget
bill, supplementary appropriation bill or bond issue bill, shall
not revert to the General Treasury, but may be expended, for
capital purposes only subsequent to the fiscal year for which
the same was appropriated, with the approval of the Board of
Public Works, and shall be carried in a capital account until
so expended or until reappropriated to the same or some other
purpose by subsequent legislative action.
4. Any receipts from sources estimated and calculated
upon in any budget bill or supplementary appropriation bill
in excess of such estimates, shall remain in the General Treas-
ury until appropriated by subsequent legislative action.
5. Any funds derived from a gift or legacy, corning into the
hands of any department, board, commission, officer or insti-
tution of the State, may be expended in accordance with the
terms of such gift or legacy, provided the Governor shall have
previously assented to the acceptance of such gift or legacy.
6. Any funds paid into the Treasury of the State for the
use of any department, board, commission, officer and institu-
tion of the State from sources not estimated or calculated
upon in the budget and dedicated by any Act of Congress or
the laws of this State to some specific purpose or purposes,
may be disbursed by the Treasurer upon warrant of the Comp-
troller to such department, board, commission, officer or insti-
tution, and expended for the purpose or purposes for which
the same are dedicated.
7. Any funds coining into the hands of any department,
board, commission, officer or Institution of the State, from
sources not estimated or calculated upon in the budget, and
not dedicated by any Act of Congress or the laws of this
State to some specific purpose or purposes, shall be accounted
for to the Comptroller, and paid into the Treasury of the
State, and any such funds may be disbursed by the Treasurer
upon warrant of the Comptroller for necessary current op-
erations of said department, board, commission, officer and in-
stitution, with the approval of the Governor.
8. The items and amounts making up the appropriations
in any budget bill, supplementary appropriation bill or bond
issue bill shall represent the initial plan of disbursement and
apportionment of the appropriations of which they are part.
Each appropriation shall be paid out only in accordance with
