976                         LAWS OF MARYLAND.                  [CH. 389

SECTION 1. Be it enacted by the General Assembly of
Maryland, That a new section be and it is hereby added to
Article 12 of the Code of Public Local Laws of Maryland
(1930 Edition), title "Garrett County, " to be under sub-title
"Amusements, " said new section to be known as Section 18A,
to follow immediately after Section 18 of said Article, and to
read as follows:

18A. No person, firm, association or corporation shall give
any circus, carnival, sporting or theatrical performance or
amusement of any kind, for which an admission is charged, in
the open air or under a tent or other temporary inclosure, with-
out first securing a license therefor from the Clerk of the
Circuit Court of Garrett County. Said license shall be ten
dollars ($10. 00) for the first tent or inclosure and five dollars
($5. 00) for each additional tent or inclosure, plus a fee of
fifty cents (50c) to cover the cost of issuance. Any person,
firm, association or corporation violating the provisions of this
section shall be guilty of a misdemeanor, and, upon conviction
thereof, shall be punished by a fine of not less than twenty-five
dollars ($25. 00) nor more than one hundred dollars ($100. 00).

The provisions of this section shall not apply to religious,
fraternal or agricultural associations holding fairs, carnivals
or amusements where the proceeds derived therefrom are used
to further the work of said associations.

SEC. 2. And be it further enacted, That this Act is hereby
declared to be an emergency law and necessary for the im-
mediate preservation of the public health and safety, and being
passed upon a yea and nay vote, supported by three-fifths of
all the members elected to each of the two Houses of the
General Assembly, the same shall take effect from the date
^of its passage.
