judges of election, and Robert Palmer and Richard Johnson
as clerks; and if any of said committee are unable or decline to
serve, the remaining members of said committee are empow-
ered to select some resident voter of said town to fill his place.

The qualifications of voters on the referendum election shall
be the same as those hereinbefore set forth in regard to general
elections.

The said committee shall, not less than five days before said
referendum election, post in five conspicuous places in said town
a written or printed notice notifying all the residents of said
town who are qualified to vote under this Act that an election
will be held on the date fixed in this Act at a certain place and
between certain hours, which notice shall contain the said date,
the hours that the polls will remain open and the location of
the polling place or places, and a statement that the election
is to be held for the purpose of deciding whether or not to
adopt this charter and form an incorporated town.

The said committee shall provide and furnish the place or
places where such election shall be held, the booths, ballot
boxes and sufficient number of printed ballots, upon which on
one line the words aFor Incorporation" shall be printed, and
on another line the words "Against Incorporation, " with
squares opposite each.

It shall be the duty of said committee, or their successor or
successors in office, to determine the qualifications and right
of each voter to participate in the special election provided for
in this section by asking each applicant who presents himself
or herself to cast his or her ballot at an election, under oath,
these questions:

1.     Are you a citizen of the United States ?

2.     Have you resided within the corporate limits of the
Town of Fairmount Heights as provided in this Act for 365*
days previous to this election ?

3.     Are you a registered voter of Prince George's County,
Maryland ? Should the answers of the applicants be in the
affirmative to each of said questions, then it shall be the duty
of said committee to allow such applicant to cast his or her
ballot, and should the answer of the applicant be in the nega-
tive to any of such questions, then and in that event he or she
shall not be allowed to vote. Should the applicant answer any
of the above provided questions falsely, he or she shall be guilty
of the crime of perjury and subject to the penalties provided
by the law for the State of Maryland.
