Commissioners shall print such person's name upon the ballot,
with a square opposite each, the names appearing in the order
in which their petitions were received by the Commissioners.
Preceding the list of names on the ballot, there shall appear
a statement instructing the voter how many persons to vote
for. Immediately upon the closing of the polls the ballots
shall be publicly counted and the said judges shall within two
days thereafter make a true and correct return of the votes so
cast in a sealed envelope to the chairman of the said Com-
missioners, and within ten days thereafter the said Commis-
sioners shall meet and canvass said return and declare those
qualified persons receiving the highest number of votes duly
elected. In case two or more persons shall have received the
same number of votes so that there is no choice for the office,
a new election shall be immediately proclaimed by the said
Commissioners from among such tie candidates, which elec-
tion shall be held on five days' notice and in all respects as
aforesaid except as to the day of election and the convening of
the Commissioners.

SEC. 6. And be it further enacted. That it shall be the duty
of the judges of election to determine the qualification and
right of each voter to participate in any election provided for
in this Act by asking each applicant who presents himself or
herself to cast his or her ballot at an election, under oath,
these questions:

1.     Are you a citizen of the United States ?

2.     Have you resided within the corporate limits of the
Town of Fairmount Heights as provided in this Act for 365
days previous to this election ?

3.     Are you a registered voter of Prince George's County,
Maryland ? Should the answers of the applicants be in the
affirmative to each of said questions, then it shall be the duty
of said committee to allow such applicant to cast his or her
ballot, and should the answer of the applicant be in the nega-
tive to any of such questions, then and in that event he or she
shall not be allowed to vote. Should the applicant answer any
of the above provided questions falsely, he or she shall be
guilty of the crime of perjury and subject to the penalties pro-
vided by the law for the State of Maryland.

SEC. 7. And be it further enacted, That the Commission-
ers elected shall hold office for one year from the third Tues-
