shall be constitutional and valid when otherwise applied, such
adjudication shall not affect, impair or invalidate said clause,
sentence, paragraph or section, but shall be confined to the par-
ticular application so found unconstitutional or invalid.
SEC. 21. And be it further enacted, That this Act is hereby
declared to be an emergency law and necessary for the imme-
diate preservation of the public safety and health, and being
passed by a yea and nay vote supported by three-fifths of all
the members elected to each of the two Houses of the General
Assembly, the same shall take effect from the date of its
passage.

CHAPTER 201.
AN ACT to incorporate the Town of Fairmount Heights to
include the communities or the subdivisions commonly
known as Fairmount Heights, North Fairmount Heights,
Bryn Mawr, Waterford, part of West Fairmount Heights,
part of Weisner's subdivision, part of Slocum's subdivision,
part of Silence subdivision and/or such parts thereof and
such further territory as may be included in the metes and
bounds description more particularly hereinafter set forth
in this bill, all of which is located in Prince George's Coun-
ty, Maryland; to provide for the government thereof, and
to provide for the submission of this question to the qualified
voters of said town for their adoption or rejection, and to
"provide for the election and succession of a Board of Com-
missioners to be named and known as "Commissioners of
Fairmount Heights, " who shall have power to make and en-
force rules and regulations for the public health and safety,
. and to authorize, empower and direct the said Commission-
ers of Fairmount Heights to make annual levies of not to
exceed ten (10) cents on each one hundred ($100) dollars
of the assessable value of the real property of the said Town
of Fairmount Heights; for the purpose of improving, main-
taining, repairing and lighting roads, streets, alleys, lanes,
sidewalks, parking, for improvement of drainage, and for
other public improvements, and for providing police and
fire protection and other public service, and for defraying
