bly of. Maryland, Session of 1929, as Section 746 of said
Article, so as to eliminate the requirement that the Board
of County Commissioners of Montgomery County shall make
an annual levy of thirty-five dollars ($35. 00) per mile for
the repair of dirt roads in said county, three hundred dollars
($300. 00) per mile for the repair of macadam roads and
six cents on one hundred dollars ($100. 00) of the taxable
property in the county for resurfacing macadam roads and
to apportion the amounts so caused among the respective
election districts of said county and to authorize and direct
said Board of County Commissioners to levy such sums as
may be deemed necessary for the repair of all county roads
and to provide for the apportionment of the monies so levied
among the various Commissioner Districts of said county.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Section 449 of Article 16 of the Public Local
Laws of Maryland, title "Montgomery County, " sub-title
"Roads, " said section and Article as edited by Horace E. Flack
and legalized by Chapter No. 193 of the Acts of the General
Assembly of Maryland, Session of 1929, appearing as Section
746 of said Article 16, be and the said section is hereby re-
pealed and re-enacted so that said Section 449 or Section 746
of said recodification shall read as follows:

449. The Board of County Commissioners shall levy an-
nually against all the taxable property of Montgomery County
such sum as may annually be deemed necessary to repair any
and all roads in said county, with which the county is charged
with the duty and expense of maintenance, said sums when
collected shall be apportioned among the respective Commis-
sioner Districts as follows: Ten per centum of the total amount
levied shall be expended for the repair of county roads lying
in each of Commissioner Districts No. One, Two, Three, Four
and Six, and twenty-five per centum of the total amount levied
shall be expended for the repair of county roads in the Fifth
Commissioner District, and the remaining twenty-five per
centum shall be expended for the repair of county roads
in the Seventh Commissioner District. The said Board is here-
by authorized to pay or refund to each existing munici-
pality and special taxing areas in Montgomery County
out of the funds collected for road maintenance as here-
in provided, a sum equal to the amount paid or refunded
to any such municipality or special taxing area out of the tax
