yea and nay vote, supported by three-fifths, of all the members
elected to each of the two Houses of the General Assembly,
the same shall take effect from the date of its passage.

CHAPTER 107.

AN ACT to repeal and re-enact, with amendments, Section 24
of Article 24 of the Code of Public Local Laws of Mary-
land (1930 Edition), title "Worcester County, ' sub-title
"Berlin, ' to give the Mayor and Council of Berlin increased
powers to limit construction of buildings and structures in
the Town of Berlin to certain kind of building materials
and thickness of walls in such territory or zone as may be
designated from time to time by ordinance; providing for
application for and issuance of building permits and pen-
alty and remedy for violations.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Section 24 of Article 24 of the Code of Public
Local Laws of Maryland (1930 Edition), title "Worcester
County, " sub-title "Berlin, " be and it is hereby repealed and
re-enacted, with amendments, to read as follows:

24. Power is hereby given to the Mayor and Council of
Berlin and to their successors in office to restrict and prevent
any person, persons or body corporate from building, erecting,
constructing, remodeling, repairing or maintaining any dwell-
ing, shop, factory, store or other building or structure of any
kind whatsoever within such limits of the Town of Berlin as
may be designated from time to time by ordinance of the
Mayor and Council of Berlin, unless such construction, re-
modeling or repairing be of brick, stone, hollow tile with stucco
face or veneer brick face, or concrete blocks, the outer walls of
which, in any case, shall be at least eight inches thick, and the
roof of which shall be of fire resisting material; and the Mayor
and Council of Berlin is. hereby authorized to establish such
zone and change same from time to time by ordinance as may
be deemed desirable or necessary, and such ordinance may also
provide for application for and issuance of a building permit
covering construction in said zone and may prescribe the re-
