If at any election for mayor or councilmen there shall be a
tie vote between any candidate or candidates for the same
office, a special election shall be called by the Mayor and Coun-
cil within sixty days thereafter and shall be conducted in the
same manner as is provided for in this sub-title.

MAYOR AND COUNCIL.

OFFICERS ELECTED.
List and Qualifications.

94.      The government of said town shall be vested in a major
and four councilmen, the latter to be resident one in each of
the four wards of said town.

The Mayor of said town shall be a legal voter of said town
at time of his election, not less than twenty-five years of age,
a citizen of the United States, an owner of real estate property
in Chestertown amounting to five hundred dollars ($500. 00),
and shall have been a resident within the limits of said town
for not less than two years next previous to- the date of the
election. In case the Mayor should change the place of his
abode from said town, he shall cease to be Mayor, and there
shall exist a vacancy in said office to be filled as hereinafter
provided.

The Councilmen of said town shall possess the same quali-
fications as the Mayor and shall qualify and be qualified in
the same manner as does the Mayor. Each of said Council-
men in addition to such qualifications shall dwell, at the time
of his election, in the ward which he is elected to represent,
and in case he moves, during his term of office, from the ward
for which he is elected, his term shall at once terminate and
there shall exist a vacancy in the office of Councilmen of such
ward, to be filled as hereinafter provided.

95.      The Mayor elected hereunder shall, before he enters
upon the discharge of the duties of his office, qualify by taking
an oath, before the clerk of the Circuit Court for Kent County,
"that he will obey the Constitution of the United States, the
Constitution and laws of the State of Maryland and that he
will diligently and faithfully without favor, partiality or preju-
dice, perform the duties of the office of Mayor of Chestertown, "
and a certificate showing the taking of said oath shall be re-
turned by said clerk, filed and recorded among the proceed-
ings of the Mayor and Council of Chestertown.
