at any time between the hours of 10 A. M. and 6 P. M., pro-
vided the time, place and terms of said sale, together with a
full detailed description of said motor vehicle or part thereof,
shall be inserted in one or more daily newspapers published in
Baltimore City at least once each week for two successive weeks
prior to said sale; and provided further, that a registered
notice shall be mailed at least ten days prior to said sale to the
owner, lien holder, if any, shown on the records of the Motor
Vehicle Commissioner of Maryland, or the person, firm or cor-
poration entitled to the possession of said motor vehicle or part
thereof, if his or its address be known, or if it can be ascer-
tained by the exercise of reasonable diligence. If said ad-
dress cannot be ascertained as above provided, then such notice
shall not be required to be given. Any excess in the amount
of the selling price of such motor vehicle, or part thereof, at
said sale, over and above the expenses thereof, and the amount
of the storage and necessary repair charges incurred by the
Police Commissioner during the period during which the said
motor vehicle, or part thereof, was in his custody, and after
the payment of all liens to which said motor vehicle, or part
thereof, may be subject, in the order of their priority, shall be
accounted for and deposited in the Special Fund of the Police
Department of Baltimore City. If the owner, or the person,
firm or corporation entitled to the possession of said motor vehi-
cle, or part thereof, shall present to the Police Commissioner
a claim for such excess at any time within three years of the
date of the sale, the Police Commissioner shall cause to be
paid from the Special Fund the amount of such excess to the
person, firm or corporation legally entitled thereto. If no
claim for the excess is made within three years from the date of
the sale, such excess shall become the property of the Special
Fund of the Police Department in the same manner as other
revenues provided by Section 776C of the Article.

The certificate of the Police Commissioner for Baltimore City
that he has sold any motor vehicle at public auction as above
described to a purchaser, shall constitute sufficient evidence
of title to any motor vehicle so sold in order to enable any
such purchaser to obtain a certificate of title and registration
from the Commissioner of Motor Vehicles of Maryland.

SEC. 2. And be it further enacted, That this Act shall take
effect on June 1st, 1931.
