CHAPTER 463.

AN ACT to repeal and re-enact with amendments Chapter 711
of the Acts of the General Assembly of Maryland, Session
of 1927, entitled "An Act to authorize and empower the
County Commissioners to make a special levy on each $100
of the whole assessable property situate in the sub-division of
Battery Park, Montgomery County, to produce the sum of
one thousand dollars ($1, 000) annually for the purpose of
maintaining a community house if 50 per cent or more of the
registered voters residing in said sub-division shall petition
therefor, " so as to authorize the expenditure of the special
annual levy collected upon the assessable property in Battery
Park for the acquisition, maintenance and development of the
Battery Park Community House and grounds.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Chapter 711 of the Acts of the General Assembly
of Maryland, Session of 1927, entitled "An Act to authorize and
empower the County Commissioners to make a special levy on
each $100 of the whole assessable property situate in the sub-
division of Battery Park, Montgomery County, to produce the
sum of one thousand dollars ($1, 000) annually for the purpose
of maintaining a community house if 50 per cent or more of the
registered voters residing in said sub-division shall petition there-
for, " be and the said Act is hereby repealed and re-enacted to
read as follows:

That the Board of County Commissioners of Montgomery
County at the time of the annual tax levy, beginning with the
levy of the year 1927, are hereby authorized and empowered
to make special annual levy of such amount as may be neces-
sary to produce annually the sum of one thousand dollars
($1, 000) on each $100^ of the whole assessable property situate
in the sub-division of Battery Park, Section One, as recorded
in Plat Book No. 1, plat 245, and in Battery Park, Section Two,
as recorded in Plat Book No. 3, plat No. 260, and in Battery
Park, Section Three, as recorded in Plat Book No. 3, plat No.
261, all of said plat books and plats being a part of the land
records of Montgomery County, Maryland, to be collected as
other county taxes in said county are collected and said special
annual levy so collected shall be paid over by the said County
Commissioners to the Treasurer of the Battery Park Citizens'
Association to be used by said association exclusively for the
acquisition, maintenance and development of the Battery Park
Community House and grounds, provided that 50 per cent or
more of the registered voters of Montgomery County, residing
in said Battery Park, Section 1, Section 2 and Section 3, shall
thirty days prior to each annual levy petition the said County
Commissioners, thereby asking that such special levy be made.
