301C. Any person duly qualified and desiring to become a
candidate for commissioner of the town of Princess Anne at
any of the elections provided in Section 301 of this Article,
shall file a certificate of candidacy with the President and Com-
missioners of Princess Anne ten days before any such election,
giving the name of such candidate, his age, and place of resi-
dence, and certifying under oath that he has resided in the town
of Princess Anne for at least one year preceding such election;
, the President and Commissioners of Princess Anne shall there-
upon prepare a ballot containing the names of all candidates
for town commissioner at such election, so arranged that the
voter may indicate his choice of such candidate by making a
cross-mark in a square provided for such purpose opposite the
name of any candidate; said ballots shall be delivered, to the
judge of election by said President and Commissioners of
Princess Anne together with the register of voters, which said
register shall be kept in the possession of the said President
and Commissioners of Princess Anne when not in the custody
of the registration officer and Judge of election as herein pro-
vided, and before permitting any one to vote at said election
the judge of election shall first ascertain whether the name of
such voter appears upon such register and if so such voter shall
be given a ballot upon which the said judge of election shall
endorse the initial letters of his name in ink or indelible pencil;
the voter, after marking said ballot, shall return it to the judge,
who shall thereupon mark after the name of such voter in the
column provided for such purpose the letter "V"; the polls on
said election day shall be kept open from eight A. M. until six
P. M. and after the close of said polls the judge of election shall
count and canvass said ballots and certify the result of said
election to the President and Commissioners of Princess Anne,
who shall give notice forthwith to the candidate having the
highest number of votes of his election; any candidate at said
election may obtain a recount and re-canvass of the votes cast
at said election or attack the same for any fraud or irregularity
in the conduct thereof, by petition addressed to the Circuit
Court for said Somerset County and said Court shall have full
power to re-count and re-canvass said ballots and correct the
result thereof and order the said judge to make anew certificate
of returns therefrom, or the said Court, upon being satisfied
that said election was irregularly or fraudulently conducted to
an extent that might have affected the result thereof, shall have
full power to set aside the same and order a new election, after
such notice as the Court by its order may prescribe, and the
decision of said Court shall be final, provided that any such
petition for review or re-count or attacking such election for
fraud or irregularity must be filed within ten days after said
election, and the ballots cast at said election shall be delivered
