108                         LAWS OF MARYLAND.                   [CH. 67

Local Laws of Maryland (1930 Edition), title "Garrett Coun-
ty, " sub-title "Justice of the Peace and Constables, " be and the
same is hereby repealed and re-enacted, with amendments, and
that a new section be and the same is hereby added to said
article, said new section to be known as Section 238A, to fol-
low immediately after Section 238 of said article, and all to
read as follows:

238. The Constables of Garrett County shall be entitled to
charge and receive the following fees for services rendered by
them in criminal cases:

For serving and return of State's Warrant........ $1. 00

For each mile traveled by him in serving and return

of said warrant.............................. 05

For taking prisoner from place of arrest to justice

of peace in said county; each mile............... 05

For delivering prisoner committed to jail, to jailer... 75
For each mile traveled in so doing, including convey-
ance for self and prisoner..................... 10

For serving summons for witnesses in criminal case,

each witness................................ 25

For serving and return of search warrant........... 1. 00

For any other service rendered in criminal cases, and
not herein enumerated, he shall be entitled to re-
ceive a fair and reasonable sum, to be determined
by the County Commissioners.

238A. It shall be the duty of the constable in taking pri-
soner before a justice of the peace for a hearing, to take said
prisoner before the justice of said county residing nearest to
the place of arrest, unless the warrant for the arrest has been
issued by some other justice of the peace. It shall be unlawful
for any constable to receive any other compensation from the
County Commissioners other than that herein set forth.

SEC. 2. And be it further enacted, That all Acts or parts of
Acts inconsistent with the provisions of this Act, are hereby
repealed.

SEC. 3. And 'be it further enacted, That this Act shall take
effect June 1st, 1931.
