406. For violation of any of the provisions of this Act
proceedings may be instituted against the owner or man-
ager who is responsible for the business transacted, to-
gether with the certified tester or the person weighing and
sampling, either or all, to be held equally responsible.
407. Any person or persons violating any of the pro-
visions of this Act except Section 2 shall be guilty of a
misdemeanor and upon conviction thereof shall be sen-
tenced to pay a fine of not less than ten dollars ($10. 00)
or more than fifty dollars ($50. 00), or imprisonment in
the county jail for not less than ten days or more than
thirty days, or both, at the discretion of the court. Any
person or persons, found guilty of violation of Section 2
of this Act shall be guilty of a misdemeanor and upon con-
viction thereof shall be sentenced to pay a fine of not less
than one hundred dollars ($100. 00) or more than one
thousand dollars ($1, 000. 00) or imprisonment in the coun-
ty jail for not more than nine months.
All fines and penalties imposed and received for the vio-
lation of any of the provisions of this Act shall be paid
to the University of Maryland College of Agriculture or
its agents and all monies so collected shall be used to meet
the expenses of the University of Maryland College of
Agriculture in the enforcement of this sub-title until Sep-
tember 30, 1937. Thereafter all fees received under this
sub-title shall be paid into the State Treasury to be used
solely in enforcing the provisions of this sub-title and
shall be included in the State Budget to be submitted to
the General Assembly at each regular session.
SEC. 2. All Acts and parts of Acts inconsistent with
this Act be and the same are hereby repealed to the ex-
tent of such inconsistency.
SEC. 3. If any provision of this Act is declared uncon-
stitutional or the applicability thereof to any person or
circumstance is held invalid, the constitutionality of the
remainder of the Act and the applicability thereof to other
persons and circumstances shall not be affected thereby.
SEC. 4. And be it further enacted, That this Act shall
take effect June 1, 1935.
