397. No person, association, copartnership, or corpora-
tion purchasing milk or cream and paying for the same
on the basis of the percentage of butterfat contained
therein shall, if the percentage of butterfat is ascertained
by the said "Babcock Test", use any test glassware except
standard Babcock Test glassware and weights which have
been previously inspected, tested and approved by the Uni-
versity of Maryland College of Agriculture or its agents.
If the proportion of butterfat is determined by any ap-
proved volumetric method other than the "Babcock Test"
no utensil or instrument shall be used in such determina-
tion until the same has been inspected, tested and ap-
proved by the University of Maryland College of Agri-
culture or its agents. The said University of Maryland
College of Agriculture shall have the right to make a
reasonable charge not to exceed five cents per item for
inspecting, testing and approving such glassware and
weights.

398. Every person, association, copartnership, corpor-
ation, or agent or servant thereof engaged in the business
of receiving or buying milk or cream on the basis of or
in any way with reference to the amount of butterfat con-
tained therein, or tests made for official inspection or pub-
lic records as determined by the "Babcock Test" shall have
the test or tests made only by a licensed tester who shall
be responsible for the same and who shall, immediately
after such tests are completed, prepare a list containing
the names or numbers of the producers whose milk or
cream was so tested and place opposite each such pro-
ducer's name or number the percentage of butterfat found
to have been contained in the sample of milk or cream rep-
resenting the milk or cream delivered by each such pro-
ducer. Such lists so prepared shall be made with indelible
pencil or ink and shall be filed in the plant or place where
such milk or cream is bought or received, and each such
list shall be duly signed by the person making such tests
and preparing such lists, and such person shall place be-
neath his signature the number of the state license under
which he is testing. All such lists shall be kept as a rec-
ord for at least one year and shall be open to examination
at all times by the University of Maryland College of Ag-
riculture or its agents.. At any time, upon request of any
producer, the purchaser or receiver of such milk or cream
shall permit such producer to examine such part of said
record as contains information concerning the samples of
milk or cream representing the milk or cream delivered by
