CHAPTER 375.
AN ACT to add four new sections to Article 48 of the Anno-
tated Code of Maryland (1924 Edition), title "Inspec-
tions, " to be under sub-title "Eggs, " said new sections to
be known as Sections 130A to 130F, both inclusive, and
to follow immediately after Section 130 of said Article,
defining fresh eggs and providing the method of de-
termining the same, and prohibiting the sale of any eggs
as fresh that do not meet the requirements of fresh eggs;
defining egg sizes and prohibiting the sale of eggs accord-
ing to size unless size requirements are met; and provid-
ing how this Act shall be administered and enforced, and
providing the penalties for any violation of this Act.
SECTION 1. Be it enacted by the General Assembly of
Maryland, That four new sections be and they are hereby
added to Article 48 of the Annotated Code of Maryland
(1924 Edition), title "Inspections, " to be under sub-title
"Eggs, " said new sections to be known as Sections 130A
to 130D, both inclusive, to follow immediately after Sec-
tion 130 of said Article, and to read as follows:
130A. No person, firm, association or corporation shall
sell, offer or expose for sale, advertise or in any other
manner represent for sale as fresh, hennery, new laid, best,
direct from the farm, or under any word, words, sign,
figures, symbols or descriptions of similar import, any
eggs that are not fresh, with such "tolerances" as are
hereinafter in this section allowed for fresh eggs. For
the purpose of this Act, no eggs shall be deemed fresh that
does not meet the following standards of quality for fresh
eggs: air cell, not over one-quarter (*4) inch deep, local-
ized and regular; white, firm and clear; shell, sound and
clean; yolk, no visible defect or blemish, and with no visi-
ble germ development. The final determination as to
meeting the standards of quality for fresh eggs shall be
made by candling.
130B. No person shall sell to the retailer or to the con-
sumer, as large, as medium, or as small (or pullet) any
eggs that are not large, medium or small.
In lots of eggs sold to the retailer or to the consumer
as fresh, a tolerance of two (2) eggs having no serious
defects shall be allowed in each dozen. In lots of eggs sold
to the retailer or to the consumer as large, medium or
small, a tolerance of two (2) eggs of the next lower weight
