and re-enacted by Chapter 339 of the Acts of 1931, re-
lating to filing of claims by employees.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Section 39 of Article 101 of the Annotated
Code of Maryland (1924 Edition), title "Workmen's Com-
pensation, " sub-title "Claims and Compensation; Benefits, "
as repealed and re-enacted by Chapter 339 of the Acts of
1931, be and the same is hereby repealed and re-enacted,
with amendments, to read as follows:

39. When an employee is entitled to compensation under
this Article, he shall file with the Commission his applica-
tion and the report of the physician, provided he was at-
tended by a physician of his own selection, within sixty
days after the beginning of his disability, for which
compensation is claimed, and failure to do so, unless excused
by the Commission, either on the ground that the insur-
ance carrier or the employer has not been prejudiced there-
by, or for some other sufficient reason, shall be a bar to any
claim under this Article; provided, however, that failure of
an employee to file a claim for compensation within one year
after the beginning of his disability shall constitute a com-
plete bar to any claim under this Article, unless it shall be
established that failure to file such claim was induced or
occasioned by fraud, or by facts and circumstances amount-
ing to an estoppel, in which case the claim shall be filed
within one year from the time of the discovery of the fraud,
or within one year from the time when the facts and cir-
cumstances amounting to en estoppel cease to operate, and
not afterwards.

When death results from injury the parties entitled to
compensation under this Article, or someone in their behalf,
shall make application for same to the Commission, within
one year from the date of death, which application must be
accompanied with proof of death and proof of relationship
under this Article, certificates of attending physician, if at-
tended by a physician and such other proof as may be re-
quired by the rules of the Commission.

SEC. 2. And be it further enacted, That this Act shall
take effect June 1, 1935.
