section to be known as Section 98B and to follow im-
mediately after Section 98A of said Article, as enacted
by Chapter 302 of the Acts of the General Assembly of
1933, prohibiting the planting, importation or transpor-
tation of seed or merchantable oysters in the State of
Maryland from another State, or from one locality to
another in this State, when the same are infected by the
oyster drill or screw borer, and authorizing the Conser-
vation Commissioner to inspect oysters imported into
the State and to seize and destroy any oysters so in-
fected wherever the same may be found.
SECTION 1. Be it enacted by the General Assembly of
Maryland, That a new section be and the same is hereby
added to Article 72 of the Code of Public General Laws of
Maryland, 1929 Supplement, title "Oysters, " sub-title
"Oyster Culture, " as enacted by Chapter 302 of the Acts
of the General Assembly of 1933, said new section to be
known as Section 98B, to follow immediately after Sec-
tion 98A, and to read as follows:
98B. It shall be unlawful for any person to plant, im-
port or transport any seed or merchantable oysters in the
State of Maryland from another State, or from one locality
to another in this State, or to introduce seed or merchant-
able oysters into any of the waters of this State, when the
same are infected by (Urosalpinx cinerea Say), commonly
known as the oyster drill or screw borer. It shall be the
duty of the Conservation Commissioner to inspect all oys-
ters imported into the State for the purpose of planting,
and he is authorized to seize, condemn and destroy any in-
fected oysters so found. The Conservation Commissioner
is further authorized to seize, condemn and destroy any
seed or merchantable oysters so infected wherever the same
may be found, and to close infected areas and prevent the
taking of oysters therefrom, so far as may be necessary to
prevent the spread of said oyster drill.
SEC. 2. And be it further enacted, That this Act is
hereby declared to be an emergency law and necessary for
the immediate preservation of the public health and safety,
and being passed upon a yea and nay vote, supported by
three-fifths of all the members elected to each of the two
Houses of the General Assembly, the same shall take effect
on the date of its passage.
