CHAPTER 78.

AN ACT to repeal and re-enact, with amendments, Sec-
tions 318 and 319 of Article 27 of the Annotated Code of
Maryland, 1924 Edition, title "Crimes and Punish-
ments, " sub-title "Larceny, " increasing the minimum in
larceny from five dollars or upwards to twenty-five dol-
lars or upwards, and providing that the theft of prop-
erty under the value of twenty-five dollars shall be a
misdemeanor, and prescribing the penalties therefor,
and fixing the time within which actions may be brought,
and conferring jurisdiction upon certain Justices of the
Peace of the Counties, and providing method of proced-
ure; and to add a new section to follow immediately
after Section 319, to be designated as Section 319A,
making the breaking of any shop, store house, tobacco
house or warehouse, with intent to steal an amount
under the value of twenty-five dollars, or stealing, in
such breaking, an amount under the value of one dollar,
misdemeanors, and providing jurisdiction and penalties
for same; and providing further that nothing in this
Act shall be construed to interfere with any prosecution
that has or may hereafter be commenced for any viola-
tion of these sections, hereby repealed or added, happen-
ing previous to the date this law becomes effective.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Sections 318 and 319 of Article 27 of the
Annotated Code of the Public General Laws of Maryland,
1924 Edition, title "Crimes and Punishments, " sub-title
"Larceny, " be and the same are hereby repealed and re-
enacted, with amendments, and adding thereto one new
section to be designated as Section 319A.

318. Every person convicted of the crime of larceny
to the value of twenty-five dollars or upwards, or as ac-
cessory thereto before the fact shall be deemed guilty of a
felony, and shall restore the money, goods or things taken
to the owner, or shall pay him the full value thereof, and
be sentenced to the penitentiary for not more than fifteen
years, or to the House of Correction or Jail for not more
than ten years.

319. If any person shall steal, take and carry away
personal goods of another under the value of twenty-five
dollars and being thereof convicted he shall be deemed
guilty of a misdemeanor, and shall restore the goods and
