SECTION 1. Be it enacted by tlie General Assembly of Mary-
land, That Section 17 of Article 77 of the Annotated Code of
Maryland (1939 Edition), title "Public Education", sub-title
"Chapter 3. State Board of Education", be and the same is
hereby repealed and re-enacted, with amendments, so as to
read as follows:
17. The members of the State Board of Education and the
State Superintendent of Schools shall be the Trustees of the
State Normal Schools, and shall have power-to maintain and
shall exercise general control over these schools. Whenever
land, interests in land, easements in, to or over land, and
mineral rights in? to or under land, or any or all of the afore-
going, shall be required, in the opinion of the State Board of
Education, for or in connection with the site of the State
Teachers College at Frostburg, or for enlarging the site or
grounds of said State Teachers College or for purposes in
connection with the construction or enlarging of said State
Teachers College, or for its preservation, or for any other
purpose in connection with said State Teachers College, its
site or grounds, and the said Board, for any cause, shall be
tillable to contract with the owner or owners thereof upon
what they deem to be a fair valuation therefor, the State
Board of Education, in any case wherein it has the power to
acquire by purchase may institute and prosecute condemnation
proceedings for the acquisition of such land, interests in land,
easements in, to or over land, and mineral rights in? to or
under land, or any or all of the aforegoing, in accordance
with Article 33A of the Annotated Code of Maryland.
SEC. 2. And be it further enacted, That this Act is hereby
declared to be an emergency law and necessary for the imme-
diate preservation of the public health and safety, and being
passed upon a yea and nay vote, supported by three-fifths of
all the members elected to each of the two Houses of the
General Assembly, the same shall take effect from the date
of its passage.
