determine, and said bonds shall be sold in the manner pre-
scribed by Section 35 of Article 31 of the Annotated Code
of Maryland (1939 Edition).
All of the proceeds from the sale of said bonds shall be used
exclusively for the construction of a water and sewerage sys-
tem for said town and for the acquisition of the property nec-
essary therefor, either by gift, purchase or condemnation, and
for any expenses in connection therewith, and the balance of
any such proceeds shall be used for the payment of interest
on said bonds.
SEC. 4. And be it further enacted, That the Mayor and
Council of Sharpsburg shall have the authority and power to
provide, by ordinance, for the payment of water and/or sewer
rents or charges for the use of the water and sewerage systems,
which said rents or charges shall be liens against the property
using same, and the receipts from said rents or charges shall
be used for the payment of said bonds and the interest thereon.
The Mayor and Council shall annually levy upon all the
assessable property liable to taxation in said town, an amount
sufficient, with the receipts from the water and sewer rents
or charges, to meet and pay the interest on said bonds so
issued and the principal of said bonds, as they shall severally
become due from time to time, which tax shall be levied and
collected as other municipal taxes now are.
SEC. 5. And be it further enacted, That this Act is hereby
declared to be an emergency measure and necessary for the
immediate preservation of the public health and safety, and
having been passed by a yea and nay vote, supported by three-
fifths of all of the members elected to each of the two Houses
of the General Assembly, the same shall take effect from the
date of its passage.

AN ACT to repeal and re-enact, with amendments, Section 17
of Article 77 of the Annotated Code of Maryland (1939
Edition),' title "Public Education", sub-title "Chapter 3.
State Board of Education", to confer upon the State Board
of Education the power of condemnation in certain instances
and upon certain conditions.
