CHAPTER 16.
(House Bill No. 22)
AN ACT to authorize the County Commissioners of Wicomico
County to acquire property or interests in property for air-
port purposes or for the enlargement of the existing airport
in said county.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That the County Commissioners of Wicomico County be
and they are hereby authorized to acquire by purchase, grant,
lease or condemnation any property or interest in property,
such as air rights, easements, or other rights, titles or interest
in property for airport purposes or for the enlargement or
adequate utilization of the existing airport in said county.
Whenever it is determined that (a) any structures or trees
are a hazard to the use of any such airport and that it is
therefore necessary or desirable to remove, lower or other-
wise terminate it, or (b) the aerial approaches to an airport
cannot be made safe or maintained in that condition by exist-
ing or future airport zoning laws, regulations or other legal
regulations which may be adopted for the protection of said
airport, or (c) it is advantageous to make aerial approaches
to an airport safe and maintain them in that condition by
the acquisition, of property rights or interests rather than by
airport zoning regulations, or (d) any zoning regulations, or
any orders, requirements, decisions or determinations issued
or made by an authority having the power to do so interferes
with the use or enjoyment of private property, or otherwise
infringes upon private property or rights therein to such an
extent that it would be an unconstitutional taking of private
property without just compensation, and the County Com-
missioners shall have the right to condemn any property or
interest therein, referred to in this Act, in order to acquire
such property rights as may be deemed necessary for any of
the purposes above specified, in the manner provided by law
under which Wicomico County is or may be authorized to
acquire property for public purposes, other than street pur-
poses or, if there be no such law, in the manner provided by
Article 33A of the Annotated Code of Maryland (1939
Edition).
SEC. 2. And be it further enacted, That this Act is hereby
declared to be an emergency law and necessary for the
immediate preservation of the public health and safety and
having been passed by a yea and nay vote, supported by three-
fifths of all of the members elected to each of the two Houses
