the Comptroller, as, in the judgment of the Comptroller shall
be sufficient to enable him to pay promptly all claims for re-
funds), as follows: one fifth thereof to the Mayor and City
Council of Baltimore, to be used for the elimination of rail-
road grade crossings within the limits of said City, and the
balance to be credited to the account of the State Roads Com-
mission of Maryland, to be paid out of the Treasury of the
State, only upon the warrant of the Comptroller, and to be
used for the elimination of railroad grade crossings, as pro-
vided by Sections 38A to 38J, both inclusive, of Article 91
of the Code of 1924, as enacted by Chapter 327 of the Acts of
1927.

CHAPTER 97.

AN ACT to authorize and direct the Burgess and Commis-
sioners of Smithsburg, Washington County, Maryland, to
borrow money on the credit of said town, and to issue bonds
for the payment of the same to an amount not to exceed
the sum of Fifty Thousand Dollars ($50, 000), for the pur-
pose of establishing, constructing and maintaining water
works and a water distributing system capable of furnishing
the residents of Smithsburg, in Washington County, Mary-
land, with a sufficient supply of water, and to levy on the
assessable property of said town to redeem said bonds and to
pay the interest thereon, and to provide for submitting the
same to the legally qualified voters of said town.

SECTION 1. Be it enacted by the General Assembly of
Maryland,
That for the purpose of establishing, constructing
sand maintaining water works and a water distributing system
capable of furnishing the residents of Smithsburg, in Wash-
ington County, Maryland, with a good and sufficient supply
of water, the Burgess and Commissioners of Smithsburg, be,
and they are hereby authorized and directed to borrow money
on the credit of said town to an amount not to exceed the
sum of Fifty Thousand Dollars, and to issue registered cou-
pon bonds of said town in payment of said sum or so much
thereof as is necessary for the establishment and construction
