recognizance in proper cases. All monies received by the Com-
missioner of Motor Vehicles pursuant to the provisions of this
sub-title, except such as shall be necessary for the purpose of

making refunds, as. in this sub-title provided, shall be accounted
for and remitted by said Commissioner to the State Treasurer,
who shall create a special fund thereof. Out of the special fund
so created, the State Treasurer shall first pay, within the limits
of the appropriations made by the General Assembly, all the
salaries and expenses of the office of the Commissioner of
Motor Vehicles and of the Traffic Court of Baltimore City.
The balance of said fund shall be disbursed, upon warrant to
the Comptroller, as follows: one-fifth thereof shall be paid to
the Mayor and City Council of Baltimore, for use on its roads?
and the remaining four-fifths shall be credited to the account
of the State Roads Commission of Maryland, to be used for the
oiling, maintenance, reconstruction and repair of State roads
and State-aided roads, and for no other purpose.

CHAPTER 96.

AN" ACT to repeal and re-enact, with amendments, Section
212-A of Article 56 of the Annotated Code of Maryland,
Edition of 1924, title "Licenses, " sub-title "Gasoline Tax, "
as enacted by Chapter 327 of the Acts of 1927, to regu-
late the method of disbursement of the revenues of the
one-half cent gasoline tax for the elimination of grade cross-
ings.

SECTION 1. Be it enacted by the General Assembly of
Maryland,
That Section 212-A of Article 56 of the Anno-
tated Code of Maryland, Edition of 1924, as enacted by Chap-
ter 327 of the Acts of 1927, be, and the same is hereby re-
pealed and re-enacted, with amendments, to read as follows:

212-A. On and after the first day of April, 1927, the li-
cense tax in respect of motor vehicle fuels, prescribed by this
sub-title, shall be increased one-half cent per gallon. The
State Treasurer shall create a special fund of the receipts from
the said additional tax of one-half cent per gallon, and shall
disburse the same monthly (less such sum to be retained by
