provisions thereof shall go into effect immediately, and if there
be a majority of the votes cast against said bond issue then
this Act shall be null and void.

SEC. 6. And be it further enacted, That this Act is hereby
declared to be an emergency law and necessary for the imme-
diate preservation of the public health and safety, and being
passed upon a yea and nay vote supported by three-fifths of
all members elected to each of the two Houses of the General
Assembly, the same shall take effect from the date of its pas-

CHAPTER 94.

AN ACT to repeal and re-enact, with amendments, Section
215 of Article 56 of the Annotated Code of Maryland, Edi-
tion of 1924, title "Licenses, " sub-title "Gasoline Tax, " to
authorize the Comptroller to retain out of the two cent Gas-
oline Tax Fund such sum as in his judgment shall be suffi-
cient to enable him to pay promptly all claims for refunds.

SECTION 1. Be it enacted by the General Assembly of
Maryland,
That Section 215 of Article 56 of the Annotated
Code of Maryland, Edition of 1924, be, and the same is hereby
repealed and re-enacted, with amendments, to read as follows:

215. Said license tax in respect to motor vehicle fuel sold
or used in any calendar month shall be paid on or before the
last day of the next succeeding month to the Comptroller who
shall receipt the dealer therefor, and shall forthwith, pay over
to the State Treasurer all monies thus received. And the
State Treasurer shall create a special fund thereof and shall
disburse the same in accordance with the appropriations there-
of made by the General Assembly, provided, however, that the
Comptroller may retain in his hands at all times such sum,,
as in his judgment shall be sufficient to enable him to pay
promptly all claims for refunds.
