pay part of the costs of improving said portions of said
streets, said property having been specially benefited by the
improvement of said portions of said streets to the extent of
said special tax or assessment by the construction of a con-
crete roadway or pavement sixteen feet wide through the
central portions of said streets and to credit on account of
said tax or assessment so levied upon any of said property,
any sum or sums heretofore paid upon that property under
any assessment heretofore made for said street improve-
ment.

WHEREAS, the Mayor and Council of Crisfield by an ordi-
nance proposed at a meeting of said Mayor and Council on
the seventeenth day of August, nineteen hundred and twenty-
seven authorized the construction of a concrete roadway or
pavement sixteen feet wide through the central portion of
Maryland Avenue from Ward's Crossing to the Pennsylvania
Railroad Crossing at North Fourth Street, and of Chesapeake
Avenue from the corner of North Fourth Street to the corner
of Somerset Avenue, and of North Fourth Street from the
Pennsylvania Railroad Crossing to the corner of Main Street,
and provided by said ordinance to assess part of the costs of
such improvement of said portions of said streets upon the
owner or owners of the property binding upon said portions of
said streets so improved as aforesaid, said assessment being
made at the rate of one dollar and ten cents per front foot
upon all property binding upon said portions of said streets,
on each side thereof, the total of said assessment upon said
abutting property owners being less than half of the total cost
of the aforesaid improvement or paving of said portions of said
streets, and after notice of said proposal of said ordinance as
aforesaid, by publication, as required by Chapter 458 of the
Acts of the General Assembly of Maryland of 1916, said ordi-
nance was finally ratified and adopted by said Mayor and
Council on the twenty-first day of September, nineteen hun-
dred and twenty-seven; and

WHEREAS, the record of the aforesaid proceeding on the
minutes of the Mayor and Council of Crisfield is defective
and erroneous, in that it appears upon said minutes that said
ordinance was passed on the said seventeenth day of August,
nineteen hundred and twenty-seven, before notice of the pro-
posal of said ordinance was given by publication as required
by said Chapter 458 of the Acts of the General Assembly of
Maryland of 1916; and
