SEC. 4. (a) And said Corporation is authorized and em-
powered to act as an agency for the Mayor and City Council of
Baltimore under the terms of said Ordinance No. 68, approved
July 10, 1868, and under any ordinance amendatory thereof or
supplemental thereto heretofore or hereafter passed, in place of
and as a substitute for the unincorporated Board of Trustees
therein named and with the rights, powers and duties of such
unincorporated Board of Trustees under such ordinance or ordi-
nances.

The unincorporated trustees under said Ordinance No. 68
shall, in addition to the powers conferred by said ordinance,
have all the powers hereby conferred on the Board of Trustees
of the corporation hereby created. And the said unincorpo-
rated trustees under said ordinance No. 68 are hereby incor-
porated under the incorporated name aforesaid and as the single
corporation hereby formed, and the said the Trustees of the Mc-
Donogh Educational Fund and Institute, so incorporated, shall
in addition to the powers conferred by said Ordinance No. 68
shall have all the powers conferred on the Corporation created
by this Act.

(b) The said Corporation created under this Act is authorized
to accept the transfer and conveyance of all the property de-
vised and bequeathed to the Mayor and City Council of Balti-
more by the will of John McDonogh and all the property devised
and bequeathed to said Mayor and City Council of Baltimore
for the McDonogh Educational Fund and Institute, or to the
Trustees of said McDonogh Educational Fund and Institute by
the parties named or referred to in paragraph (b) of Section
1 hereof, absolutely, subject, however, to such qualifications,
limitations or trusts, if any, as may be agreed upon by said Cor-
poration and the Mayor and City Council of Baltimore or as
may be expressed in the grants, wills or gifts of said other per-
sons referred to in said paragraph (b) of Section 1.

The Mayor and City Council of Baltimore is hereby authorized
and empowered to make such conveyance of any or all of said
property to the Corporation hereby created;

(c) The records, books, accounts, papers, grounds and build-
ings of said Corporation shall be at all times open to inspec-
tion and examination by the Mayor of the City of Baltimore,
and the City Council shall always have power by resolution or
otherwise to appoint committees of their body to inquire into
the affairs of said Corporation.

SEC. 5. The Corporation may hold, administer and treat all
monies or other property at any time received by or held by it
for similar purposes, whether received under the will of John
