of Maryland, title "Fish and Fisheries, " except Sections 61 to
67, inclusive; and Chapters 80, 206, 295, 325, 337, 492, 553,
574, 636, 693 and 698 of the Acts of General Assembly of
1927, amending or adding to the above Article 39; and Chap-
ter 532 of the Acts of 1927, providing for fishing and boating
on Deep Creek Lake; and so much of each Article of the Code
of Public Local Laws of 1888 as pertains to the title "Fish
and Fisheries" or related subjects but not including terrapin
and turtles, and the several Acts amendatory thereto or incon-
sistent therewith enacted since the Code of 1888, be and the
same are hereby repealed.

SEC. 2. And be it further enacted, That a new Article to
be known as Article 39, title "Fish and Fisheries, " which new
Article shall embody all the laws pertaining to the above title
in effect in the State of Maryland after the passage of this
Act, both public general and local, and continuing in effect
Sections 61 to 67, inclusive, of Article 39, which sections em-
body the concurrent legislation between the States of Mary-
land and Virginia on the Potomac River, making said sections
a part hereof to be known as Sections 57 to 63, with sub-title
"Concurrent Law on the Potomac River, " be and the same is
hereby enacted to read as follows:

DEFINITIONS.

Sec. 1. Whenever used in this Article, unless a counter
intention is evident from the context, the term "Tidal Waters"
shall include all waters of this State where the tide ebbs and
flows; and the term "Non-tidal Waters" shall embrace all
waters above a point where the tide ebbs and flows.

The word "Person" shall include Corporation, Partnership
and Joint Association.

The term "Game and Fresh Water Fish" shall include all
fishes found in all waters above a point where the tide ebbs
and flows.

APPLICATION OF GENERAL AND LOCAL LAWS.

Sec. 2. All local and general laws of this State fixing or
regulating minimum and maximum sizes of fish, crabs or
clams, or regulating or prohibiting the sale of fish, crabs or
clams, respectively, shall apply whether the same be caught
in the waters of the State of Maryland or in the waters of any
other State, Country or Territory and brought into this State,
