CHAPTER 443.
AN ACT to provide for City planning in Frederick, Maryland,
the creation, organization and powers of a Planning Com-
mission, the regulation of sub-division of land and the ac-
quisition of right to keep planned streets free from buildings,
and providing penalties for violations thereof.
SECTION 1. Be it enacted by the General Assembly of
Maryland, That the term "streets" includes streets, avenues,
boulevards, roads, lanes, alleys, viaducts and other ways. "Sub-
division" means the division of a lot, tract, or parcel of land
into two or more lots, plats, sites, or other divisions of land
for the purpose, whether immediate or future, of sale or of
building development. It includes re-sub-division and, when
appropriate to the context, relates to the process of sub-dividing
or to the land or territory sub-divided.
SEC. 2. Be it enacted, That the Mayor and Aldermen of
Frederick is hereby authorized and empowered to make, adopt,
amend, extend, add to, or carry out a municipal plan as pro-
vided in this Act and create by ordinance a planning commis-
sion with the powers and duties herein set forth.
SEC. 3. Be it enacted, That the Commission shall consist
of five members and the same persons now or hereafter author-
ized to act as a Zoning Commission may also act as a Plan
ning Commission. Said Commission shall be appointed by the
Mayor, subject to the approval of the Board of Aldermen, for
a term of four years, but of the first appointed members two
shall be appointed for a term of one year, one for a term of
two years, one for a term of three years, and one for a term
of four years. Vacancies shall be filled for the unexpired term
of any member whose term becomes vacant.
SEC. 4. Be it enacted, That the Commission shall elect
a chairman and create and fill such other of its offices as it
may determine. The Commission shall hold at least one regu-
lar meeting in each month. It shall adopt rules for trans-
action of business and shall keep a record of its resolutions,
transactions, findings, and determinations, which shall be a
public record.
SEC. 5. Be it enacted, That it shall be the function and
duty of the Commission to make and adopt a master plan
