The committee to conduct such election shall consist of John
T. Stewart, John B. Andrews, Levi Woodson, as judges of elec-
tion, and Marie Hardwick, as clerk; and if any of the said com-
mittee are unable or decline to serve, the remaining members of
said committee are empowered to select some citizen of the said
town possessing the voting qualifications as herein prescribed to
fill his or her place. The qualifications of the voters on the refer-
endum election shall be the same as those hereinbefore set forth
in regard to general elections. The said committee shall, not less
than ten days before the said referendum election, publish for two
days in some Negro newspaper published in the City of Wash-
ington, and post in five conspicuous places in the town, a written
or printed notice notifying all legal and equitable property
holders who are qualified to vote under this Act that an election
will be held on the date fixed in this Act at a certain place, at
a certain hour, which notice will contain said date, the hours
that the polls will remain open and the location of the polling
place, and a statement that the election is to be held for the
purpose of deciding whether or not to form an incorporated
town.
The said committee shall provide and furnish the place or
places where the election shall be held, the booths, ballot boxes
and sufficient number of printed ballots, upon which on one line
the words "For Incorporation" shall be printed, and on an-
other line the words ''Against Incorporation, " with squares
opposite each.
Said election shall be conducted as nearly as practicable as set
forth herein for the holding of bi-annual elections. In the event
that the majority are for incorporation, this Act shall immedi-
ately become effective, and in the event that a majority of said
votes are against incorporation, it shall become null and void.
SEC. 17. And be it further enacted, That in the event that
this charter is adopted by the citizens of said Eagle Harbor un-
der the provisions of the referendum above set forth, then the
same committee who conducted the referendum election with the
same powers of filling vacancies thereto shall on the second day
of July hold another election for the five commissioners provided
herein in the manner and form prescribed herein for general
elections, except that the said committee shall canvass the votes
cast and publicly announce the result thereof. The five persons
having the largest number of votes shall be declared by said
committee as the first Board of Commissioners for said town of
Eagle Harbor, and upon their taking the oath herein prescribed
shall become the Board of Commissioners for said town.
