An ACT respecting a Monument or Statue to the memory of Wash-
ington.
BE IT ENACTED, by the General Assembly of Maryland, That it shall and may be lawful for James A.
Buchanan, David Winchester, John Comegys, James Calhoun, jun. Nicholas G. Ridgely, James
Williams, George Hoffman, James Patrige, Robert Miller, Washington Hall, Isaac M'Kim, Le-
muel Taylor, Robert Gilmore, jun. Fielding Lucas, John Frick, James Barroll, Benjamin H. Mulli-
ken, Nathaniel F. Williams, Levi Hollingsworth, Edward J. Cole, Doctor James Cocke, William
Gwynn and William H. Winder, or a majority of them, to propose a scheme or schemes of a lottery
to raise a sum of money, not exceeding one hundred thousand dollars, clear of all expenses incurred
in drawing said lottery, and to sell and dispose of the tickets thereof; provided, the said James A.
Buchanan, David Winchester, John Comegys, James Calhoun, jun. Nicholas G. Ridgely, James
Williams, George Hoffman, James Patrige, Robert Miller, Washington Hull, Isaac M'Kim, Lemuel
Taylor, Robert Gilmore, jun. Fielding Lucas, John Frick, James Barroll, Benjamin H. Mulliken,
Nathaniel F. Williams, Levi Hollingsworth, Edward J. Cole, Doctor James Cocke, William Gwynn
and William H. Winder, or a majority of them, shall, before they undertake to act under this law,
give their bond to the state of Maryland, in the penalty of two hundred thousand dollars, conditi-
oned that they will well and truly apply so much of the money arising therefrom, within twelve
months after the drawing of said lottery, as will satisfy the fortunate adventurers for prizes drawn
by them, provided application is made for the payment of such prizes within twelve months after the
completion of said drawing, otherwise such prize or prizes shall be deemed relinquished to the ma-
nagers of the said lottery for the uses intended thereby, and shall, within five years after drawing
the same, cause the money raised by the said lottery to be laid out and expended in erecting a mo-
nument or statue to the memory of Washington in the city of Baltimore.
II. AND BE IT ENACTED, That after the new court-house of Baltimore county, now building in
the city of Baltimore, shall be so far completed as to afford suitable accommodation for the courts
and public offices' of the said county, that then the public square in North Calvert-street, in the city
of Baltimore, on part of which the old court-house of Baltimore county now stands, be and the same
is hereby appropriated for the erection of the said monument or statue, and of such improvements
suitable to the said monument or statue, as the said James A. Buchanan, David Winchester, John
Comegys, James Calhoun, jun. Nicholas G. Ridgely, James Williams, George Hoffman, James Pa-
trige, Robert Miller, Washington Hall, Isaac M'Kim, Lemuel Taylor, Robert Gilmore, jun. Fielding
Lucas, John Frick, James Barroll, Benjamin H. Mulliken, Nathaniel F. Williams, Levi Hollings-
worth, Edward J. Cole, Doctor James Cocke, William Gwynn and William H. Winder, or a majority
of them, in their discretion, shall deem proper, and power is hereby given to the said James A. Bu-
chanan, David Winchester, John Comegys, James Calhoun, jun. Nicholas G. Ridgely, James Wil-
liams, George Hoffman, James Patrige, Robert Miller, Washington Hall, Isaac M'Kim, Lemuel
Taylor, Robert Gilmore, jun. Fielding Lucas, John Frick, James Barroll, Benjamin H Mulliken,
Nathaniel F. Williams, Levi Hollingsworth, Edward J. Cole, Doctor James Cocke, William Gwynn
and William H. Winder, or a majority of them, to remove any obstructions in the way thereof, on
the said public square; and that the said persons herein named, or a majority of them, be and they
are hereby nominated and appointed to elect and fix upon such kind of monument, or statue or mau-
soleum, for the purpose therein specified, as they may deem most proper, and to make such use of
the unoccupied parts of said square as shall, in their judgment, be best calculated to add to the
beauty and design of such monument or statue.
III. AND BE IT ENACTED, That the said public square, with the said monument or statue, and
improvements thereon erected, from and after the said five years from the drawing of the said lotte-
ry, shall be, and the same is hereby vested in the mayor and city council of Baltimore, for the use
of the said city.
